baldwin faces involuntary manslaughter charge in the onset shooting of cinematographer. secret service says it does have a record of visitors to president biden's residence after all the place where he kept those classified materials. but, first, breaking tonight, investigators trying to find out who leaked a draft of the u.s. supreme court's ruling overturning the roe v. wade abortion decision. they admit they have been unable to do so. the probe will continue but no sense a culprit will be identified. bring in fox news chief legal correspondent anchor of "fox news sunday" shannon bream. >> shannon: we did get significant insight into the court's investigation into this leak but left with more questions tonight and word that the court says the investigation is not over yet. the court says 82 people had access to either electronic or hard copies of the dobbs decision, one overturning roe v. wade. 97 employees interviewed. some of them multiple times all

of them denied being the leaker. the investigation concluded that an outside hacker penetration of the court system their internal ip system is highly unlikely suggesting this was, indeed, an inside job. so the court also disclosed that it recently invited former dhs secretary michael chertoff one time judge himself to review its work and he did not suggest any additional investigative measures. while the court says the employees were asked to did turn over call and text records for personal phones nothing relevant was found there. in addition, outline personnel who are asked to submit to an interview they did so all of them also signed a sworn affidavit under penalty of perjury that they did not disclose the draft opinion to anyone who didn't work for the court. but many admitted they procedure for handling the draft including, this quote: some individuals admitted to investigators that they told their spouse or partner about the draft dobbs opinion and the vote count in violation of the

court's confidentiality rules. in the end, the court's internal investigation concluded that it was unable to identify the person responsible for the leak by a preponderance of the evidence. that is a very low standard, essentially the ability to say something is more likely than not and that suggests the court just doesn't have any strong leads. bret? >> bret: hard to believe. all right, shannon, thank you. also breaking tonight, actor and producer alec baldwin is facing an involuntary manslaughter charge over the death of a cinematographer on a movie set in october of 2021. baldwin was pointing a prop pistol at halyna hutchins touring a rehearsal when that gun went off. correspondent matt finn has details from los angeles. >> today a new mexico district attorney announcing she will file two involuntary manslaughter charges against alec baldwin and rust armourer reid. >> mr. baldwin had a duty at the base level never hold a gun and

point it at a person pulling the trigger. also had a duty as actor and producer on that set to have the bullets checked or check them himself to make sure they weren't live. >> the special prosecutor tells fox news that safety on the 2021 new mexico set was loose and reckless with accidental gun discharges and that bald win did pull the trigger on the gun he fired. a claim he denies. baldwin faces up to six and a half years in prison if convicted on the stronger involuntary manslaughter charge that carries an enhanced sentence. his attorney responding, quote: this decision distorts had halyna hutchen's tragic death and represents a terrible miscarriage of justice. mr. baldwin had no treason believe there was a live bullet on the gun or anywhere on the movie set. he relied on the professionals who assured him the gun did not have live rounds. guts reid who faces the same prison time was reportedly under experienced and overwhelmed. attorney telling fox hanna

officially. white house correspondent jacqui heinrich has the update live from the north lawn. good evening, jacqui. >> good evening, bret. president biden's announcement on a 2024 run will not come until after the state of the union. i am told that that timing is not at all influenced by the documents probe. a democrat strategist telling me it's better for biden to tout his administration's achievements and let that moment breathe before making any other major news. there is short time to turn the public's attention to other matters with many remaining questions surrounding the documents. >> the house intelligence committee formally requested a national security damage assessment over president biden's apparent mishandling of classified documents. but nine days later, there has been no response from the director of national intelligence. and nobody within the administration is willing to say if risks are being assessed. special counsel's office also declined to comment setting longstanding practice doj officials say they have given no orders on what the administration can or cannot say but the president indicated last

week he has been advised to keep quiet. >> i'm going to get a chance to speak on all of this god-willing soon. >> "the washington post" reports early on biden's attorneys and doj officials had a shared understanding to keep the matter quiet. biden hoping for a quick resolution that would find no intentional mishandling. federal investigators hoping to avoid media attention complicating the probe and now frustration in the west wing over the attorney general's decision to appoint a special counsel. >> are you satisfied with the way your team is handling the document situation? >> meanwhile house oversight republicans are turning their attention to the penn-biden center to learn who may have had access to the documents there and if there is any nexus with hunter biden's foreign business dealings. >> we are very concerned about the return on the investment that our adversaries around the world were expecting to get with respect to the millions of dollars that they were transferring into the various biden accounts. >> the university tells fox the penn biden center has never solicited or received any gifts from any chinese or other foreign entity.

100 percent of the budget for the penn biden center comes from university funds. new reports show the university got several donations from anonymous chinese sources including a gift of 14 million in 2018 and comer wants to know if any of his center's money from the school originated in chinese. >> want secret service logs detailing who may have had access to the president's home in wilming top and new tonight the secret service says they are willing to turn over that limited information that they have when they're asked by congress. but, remember, the president did not have secret service protection mid 2017 until 2021 in march when he was made the democratic nominee for president. there is a gap in time there the president just addressed these documents in his remarks in california saying they immediately turned over those documents. they are fully cooperating with the justice department and looking forward to getting this resolved quickly, bret. >> bret: jacqui heinrich live on

the north lawn. thanks. there are growing tensions tonight on capitol hill over the debt ceiling. republicans are calling on democrats to engage in talks to come up with a plan. so far democrats are refusing. they want a clean debt ceiling increase. let's find out where things stand tonight. congressional correspondent issue ha has any has our reports. >> good evening to you, bret. we are now seeing centers step in to try to avert a crisis here. today in kentucky g.o.p. leader mitch mcconnell sounding confident that the u.s. will not default on its debt. >> we'll end up in some kind of negotiation with the administration over what the circumstances or conditions under which the debt ceiling be raised. >> this comes despite the fact that house speaker kevin mccarthy isn't getting anywhere closer to a sit-down with the president. he is trying to come up with a plan to raise a debt ceiling while also balancing the budget. this is one of the concessions mccarthy made with a group of conservative hardliners in order to get the speaker's gavel.

republicans have worked with democrats before to increase the debt limit under republican presidents. but, republicans say they didn't run up the discretionary spending like democrats have for the last few years. although the national debt still ballooned by about $7 trillion under former president trump. most of that due to the covid response. now, this week, bret, democratic west virginia senator joe manchin offered to get house and senate committees together to examine trust funds like medicare and social security without getting rid of them instead analyzing them in exchange for a debt ceiling hike. but the white house continues to refuse to negotiate with republicans. >> to threaten default. to threaten economic catastrophe, nobody, democrat or republican, should do that. no matter how much they believe in their agenda. >> now, congress does have some time. it's expected to have about until summer to figure this out so we could be in this budget battle for some time.

bret? >> bret: aishah, thanks. renewed worries about a possible recession sent stocks down today. the dow lost 252 to go negative for the year. the s&p 500 fell 30. the nasdaq was off 105. up next, we will talk about some of the big stories of the day and her own political future with former u.s. ambassador to the united nations, former south carolina governor nikki haley. is she getting in the race? first, here's what some of our fox affiliates around the country are covering tonight. fox 2 in st. louis with the manhunt for five inmates who escaped from prison. authorities described three of them as known sex offenders. the jail break occurred around 7:00 p.m. tuesday when the group entered a secured cell then forced their way through a door. fox 12 in portland, as officials approve a half million dollars for relief fund for the city's marijuana shops. the funds will come from the cannabis sales tax. the city crites cites crime and

♪ ♪ >> bret: welcome back to "special report." we are joined tonight by former ambassador to the united nations and former governor of south carolina nikki haley. thanks for joining us. >> great to be with you. >> bret: listen, i want to talk about some news of the day first with you. and this document story really has gotten a lot of attention, the handling of classified documents. you've dealt with classified documents. how do you see this with president biden and what we saw with former president trump and where you come down? >> well, classified documents should never be taken into an

unsafe place. so i think that clearly president trump and president biden did it. they both should be investigated to make sure that there was no harm to our national security. but, what really gets conservatives upset is the fact that you can have republicans and democrats do the same thing and republicans are vilified and democrats just sweep it under the rug. and so that's the fbi, doj double standard. at some point something has got to give. you can't weaponize our agencies and have it play out this way. >> bret: on the world stage this week a lot of focus on davos, switzerland world economic forum. if you listen to those speeches, climate change is the biggest issue on the world stage. obviously have you iran protest, you have china on the move on a number of fronts. what do you sees a the biggest challenge for the world? >> davos is so tone deaf because if you look at the fact can't buy groceries mothers can't

formula. inflation is up. children so far behind in education i don't know that we are going to catch them up. that's great that they can go talk about the environment in davos but that's not what americans are feeling. >> bret: you were governor of south carolina. you had a good economy while you were governs. but balancing the books on a federal level has been very difficult for republicans and democrats. >> governors have to balance their budgets, right? so we do understand what it means to kind of pick and choose what you are going to spend on. when you look at the debt ceiling we're $31 trillion in debt. we are borrowing money just to make our interest payments. our debt is higher than the economy. we haven't had that since world war ii. we're certainly in a place that's not sustainable. >> bret: we talked in the fall about your ambitions. when do you make a decision whether you're going to run for president and whether former president trump decides or not, does that affect you? >> look, i've said for a long time if there's a place for me, and i put my hat, in i have never lost a race. i'm not going to start now. >> bret: you said after the

holidays that you would look at it, consider it, you would read the tea leaves in your words. we are in the new year. how are those tea leaves looking? are you going to run for president? >> well, i'm not going to make an announcement here, but when you are looking at a run for president, you look at two things. you first look at does the current situation push for new leadership? the second question is, am i that person that could be that new leader? yes, we need to go in a new direction and can i be that leader? yes, i think i can be that leader. i was, as governor, i took on a hurting state with double dignity unemployment and we made it the beast of the southeast. as ambassador, you know, i took on the world when they tried to disrespect us, and i think i showed what i'm capable of at the united nations. so do i think i could be that leader? yes. >> but we are still working through things and we'll figure it out. i have never lost a race. i said that then. i still say that now. i'm not going to lose now. but stay tuned. >> bret: it sounds like you are close. are we getting to the

exploratory committee stage here? >> i think. stay tuned. >> bret: okay. a reporter was asking you if you would support donald trump if he ran again in 2024. and you told this a.p. reporter yes. i would not run if president trump ran. and i would talk to him about it you added that's something we will have a conversation about at some point. obviously former president trump is running what has changed if you are where you are. >> i had a great working relationship with the president. i appreciate all the foreign policy issues we worked on together. but, what i will tell you is the survival of america matters. and it's bigger than one person. and when you are looking at the future of america, i think it's time for new generational change. i don't think you need to be 80 years old to go be a leader in d.c. i think we need a young generation to come in, step up and really start fixing things. and, you know, all of that when i said that was before we surrendered to afghanistan. it was before we saw this high

inflation and high crime and before we saw drugs infesting all of our states. before we saw our foreign policy in disarray. so a lot has changed. and when i look at that, i look at the fact if i'm this passionate and i'm this determined why not me? >> bret: so i have talked to a number much high profile conservatives, some of them very supportive of trump. trump supporters from the beginning who say maybe it's time, to your point for a different person to hold the torch. they love trump policies but didn't particularly love all the controversies around the man. is that what you hear? >> i don't so much listen to that as hearing all the negatives against biden. we have lost the last seven out of eight popular votes for president. seven out of eight republicans have lost. something's wrong. and so i think it's time that we bring in a new generation that can bring in more people to our party that can really talk about the solutions that we need to go. if i run, i'm running against

joe biden. that's what i'm focused on because we can't have a second term of joe biden. >> bret: you already have supporters, even though you are not declared. vanity fair had a piece in which it said kutcherner's family cozying up to nikki haley basically they support you. jared kushner's parents brought about 20 to meet nikki at the event father predicted that hali would be the first woman president. some attendees made donations to stand for america pac. so is the president's son-in-law a supporter of yours? >> look, the president's son is a friend of mine. jared and ivanka are dedear friends. that's what they're. i expect they will support the president. that's where they should be. that's who they are. but the kushners are just dear people and they have been supporters and i appreciate that. >> bret: one person who doesn't

seem to be a supporter is secretary mike pompeo who writes in his book about an oval office meeting. he says i received a call one evening from john kelly, chief of staff, who apologized for allowing ambassador hali to go to the oval office. she had gone -- not gone in for a personal matter but rather had entered the oval office with the president's daughter ivanka and her husband jared. as best kelly could tell, they were presenting a possible hali for vice president option. he was certain he had been played. is that true? were you trying to get mike pence off of that ticket? >> no. and, you know, pompeo even says he is not sure if it's true. i never had a conversation with jared, ivanka, or the president about the vice presidentship. what i will tell you is it's really sad when you are having to go out there and put lies and gossip to sell a book. i don't know why he said it but that's exactly why i stayed out of d.c. as much as possible to get away from the drama and get away from the gossip. i focused on my job and that's what i always did.

>> bret: senior trump adviser kellyanne was asked on radio show. >> that is true people were trying to get rid of mike pence off the ticket. also naive from son-in-law the police officer novices like jared kushner let's just get rid of the vice president. this whole idea let's just get a woman, get a woman, get a woman. do you know who did that? one joe biden. look what we got for it, goodness, kamala harris. i'm glad secretary pompeo has said this. >> bret: what do you say to kellyanne conway on her recollection on this. >> i literally did not speak with anyone in the administration about that at all. it was gossip. mike pence is my friend. it is gossip. it was never discussed. if somebody else discussed it, they certainly didn't discuss it with me. i mean, it's just gossip. this is all gossip. there is no truth to it. mike even says in his book it's just gossip. >> bret: do you expect this to be a bruising primary if you do get in? >> listen, politics is a blood sport. it was a blood sport in south carolina. it was a blood sport at the

♪ >> embattled homeland secretary alejandro mayorkas says will help local governments deal with the consequences of the illegal immigration surge along the southern border. secretary mayorkas told a conference of the nation's mayors financial assistance is being distributed. he continues to take heavy criticism from republicans over border policy. they plan a hearing on the issue next month. correspondent bill melugin tried to get reaction today from the secretary. >> excuse me, mr. secretary, any comments to republicans who are calling for your impeachment, sir? >> good morning. >> they have announced an oversight hearing for the border next month. will you cooperate, sir? sir? any comment for republicans calling your impeachment before we let you go. >> alan throw mayorkas answers few and far between as he arrived at the annual conscious of mayors in washington, d.c. today. there he told mayors from all around the country the federal government will help them shoulder the cost of the border crisis. >> fema is providing emergency

wait until december border numbers are released before making any decision on impeachment. and speaking of those numbers, cbp sources tell fox those december numbers are going to be the highest month ever recorded at the southern border with over 250 migrant encounters the last month. send it back to you. >> bret: striking. bill, thank you. tonight we update on the biden administration's to derestock the depleted oil reserve. the president's team is failing to meet its own goals and that raises questions about whether the nation's emergency supply can be restored correspondent gillian turner takes a look. >> energy secretary jennifer granholm is pushing back against a new bipartisan draft bill that limits president biden's ability to withdrawal oil from the strategic petroleum reserve that's the supply that helped shield americans from international supply crises. this bill would result in more oil supply shortages in times of crisis in times of crisis and

president biden withdrew 220 million barrels from the spr in 2022 in an earth to lower gas prices. leaving the reserve at a 39-year low. >> the united states government is going to purchase oil to refill the strategic petroleum reserve. when prices fall to $70 a barrel. >> today that price is still a long way off with one key benchmark wti trading at $79 a barrel. the energy department is now backtracking on the biden team plan to purchase 3 million barrels in the month of february, citing still high prices. doe will only select bid at a price that is a good deal for taxpayers in week the president is criticizing a bill that would make it much harder to release oil until the spr is replenished. >> house republicans introduced another bill on the strategic petroleum reserve. blocking action that would help lower gasoline prices and help consumers. >> but speaker mccarthy insists the legislation fixes the president's mistakes. >> we also got a bipartisan vote

nikki haley know this traditional maga base is going to be pretty difficult for her to tap into. not that she doesn't have admirers in that space. what was so interesting about her interview with you is how she is sort of road testing potential thesis statements for candidacy. you heard her on multiple generational change. that's interesting. right? obviously you have an older donald trump who is already in the race that's inherent critique resonates primary voters vis-a-vis joe biden. can you see her trying some different things here she said may the best woman win olivia at one point in a interview. i should point out we reached out to pompeo's people. they sent a statement saying secretary pomp stands by everything he wrote in his book. your thoughts, olivia? >> i love that nikki haley, mike pompeo, donald trump might all be on the campaign trail at one point together and mike pence. what stood out to me nikki
